Welcome to The LAB-ratory LLC website (the "Site"). The Site is owned and operated by The LAB-ratory LLC ("The LAB-ratory LLC”, "The LAB-ratory", "we", or "us"). By using the Site, you agree to these Terms of Use and all applicable laws and regulations, including intellectual property laws. Please read these Terms of Use carefully.

Use of Site The Site allows users to browse, select, and purchase laser-cut and engraved items and related accessories (the “Products”). Users agree not to: 

• Use the Site for any unlawful purpose or in violation of these Terms. 
• Attempt to gain unauthorized access to the Site or other user accounts. 
• Engage in any conduct that could disrupt, damage, or impair the Site. 

Intellectual Property Rights All content on the Site, including text, graphics, logos, images, and software, is owned by The LAB-ratory LLC or its licensors and is protected by United States and international intellectual property laws. The LAB-ratory LLC’s intellectual property may not be used in connection with any product that does not belong to The LAB-ratory LLC, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits The LAB-ratory LLC. All other trademarks not owned by The LAB-ratory LLC that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by The LAB-ratory LLC.

You may use the Site for personal, non-commercial purposes only. Unauthorized use of this content is prohibited. You may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store, or transmit any material on the Site without our express prior written consent. You may not use data mining, robots, or similar data gathering and extraction tools. You may not misuse the Site and can only use the Site as permitted by law. The licenses granted by The LAB-ratory LLC terminate if you do not comply with these Terms of Use or any applicable terms.

Making Purchases You must be at least 18 years old or have parental consent to purchase products on the Site. When you place an order, you offer to purchase the products according to these Terms of Use. All orders are subject to acceptance by us, and we may decline any order at our discretion. 

Product Information We strive to display product images accurately. However, the actual color, fit, and other attributes of the product you receive may differ due to your computer system. We do not guarantee that the images accurately reflect the product. 

Orders and Payment 

• Product Availability: All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or refuse any order at any time without notice. We use reasonable efforts to fulfill orders but cannot guarantee the availability of any particular product and sometimes an item may not be available. In that case, we may cancel your order or contact you for follow-up.  
• Pricing: Prices are listed in US Dollars (USD) and may include taxes, shipping, and      handling charges. Prices are subject to change without notice. In the event of pricing or other error, we reserve the right to revoke offers, cancel orders, and correct errors or omissions, including after an order has been placed.  
• Payment Terms: Payments must be made at the time of purchase. We accept      payment forms as listed on the Site. You agree to provide current, complete, and accurate billing and shipping information. By confirming your purchase at the end of the checkout process, you agree to accept and pay for all charges incurred via the applicable payment method for all products that you purchased at the price(s) in effect at that time, including sales taxes, unless otherwise noted. Receiving an order      acknowledgement via email does not guarantee acceptance of an order, or that the price or availability of a product has been confirmed. 
• Limitations on Purchases: We are not responsible for failure to fulfill orders for any reason, including causes beyond our control. We reserve the right to: (1) decline any order or limit order quantities to reasonable amounts (in our sole discretion); (2) prohibit purchases by retailers, distributors, or resellers; (3) discontinue or refuse to offer any product; (4) impose conditions on any discount, coupon or promotion;      and/or (5) bar any user from completing a transaction. 

Shipping and Delivery We ship products to addresses within the United States only and aim to dispatch orders promptly. Delivery times may vary based on the shipping method selected at checkout. The LAB-ratory LLC is not liable for delays or issues in delivery once the product has been dispatched to the shipping carrier. 

Returns and Refunds Returns and exchanges are subject to our Return Policy, accessible below.

Privacy Our collection, use, and disclosure of your personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices. 

Disclaimer of Warranties The Site and products are provided "as is" without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. THE LAB-RATORY LLC DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SITE TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND TITLE. 

NO WARRANTY OR CONDITION, EXPRESS OR IMPLIED, IS MADE REGARDING ACCURACY, ADEQUACY, COMPLETENESS, LEGALITY, RELIABILITY OR USEFULNESS OF ANY INFORMATION OR CONTENT CONTAINED ONE THE SITE. ALL DISCLAIMERS OF ANY KIND (INCLUDING IN THIS SECTION AND ELSEWHERE IN THESE TERMS) ARE MADE ON BEHALF OF THE LAB-RATORY LLC, AND ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES. 

SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS AND LIMITATIONS OF CERTAIN IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

Limitation of Liability In no event shall The LAB-ratory LLC be liable for any damages, including direct, indirect, incidental, punitive, or consequential damages arising out of or in connection with the use of the Site or products OR FOR ANY DAMAGES RELATED TO LOSS OF USE OF THE SITE OR YOUR DATA, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF THE LAB-RATORY LLC IS ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. 

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS AGREEMENT WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. 

Indemnification Except to the extent prohibited by applicable laws, you agree to defend, indemnify, and hold The LAB-ratory LLC harmless from and against any claims, damages, costs, losses, and expenses, including attorneys' fees, arising from or related to your use of the Site or any breach by you of these Terms of Use. 

Governing Law These Terms of Use shall be governed by the laws of the state of North Carolina without regard to conflict of laws principles. 

Changes to Terms of Use We reserve the right to update these Terms of Use at our discretion. Please check these Terms periodically for changes. Your continued use of the Site following any changes constitutes your acceptance of those changes.
